1 What is the status of the Co-operative Service Commission? It is a Commission constituted under the West Bengal Co-operative Societies Act, a State Act.
2 What is the function of the Commission? The Commission is set up for selecting persons for recruitment to “such posts other than the posts of Group D category and posts to be filled up by promotion” in the societies belonging to the Fifth Schedule of the West Bengal Co-operative Societies Act.
3 Which societies are included in the Fifth Schedule of the West Bengal Co-operative Societies Act? The Fifth Schedule includes all the Apex Co-operative Societies, Central Co-operative Societies (including District Co-operative Unions and Agricultural Co-operative Marketing Societies), Co-operative Agriculture and Rural Development Banks and Primary Co-operative Banks.
4 Can the co-operative societies, for whom persons are selected by the Commission for recruitment to non-Group D posts, be treated as Government offices or Government undertakings? No. These are all co-operative societies registered under the West Bengal Co-operative Societies Act. Though the State Government has contributed to the Share Capital, advanced Loan or provided Subsidy to some of these societies, none of them can be treated as Government offices or Government undertakings.
5 Can the Commission select persons for recruitment in Government offices or Government undertakings? No.
6 What is the legal status of a non-Group D employee appointed by a Co-operative Society belonging to the Fifth Schedule of the West Bengal Co-operative Societies Act, bypassing the Commission? Such appointments are void in terms of Section 94 of the West Bengal Co-operative Societies Act.
7 What is the lower age limit for application for employment through the Commission? The minimum age for direct recruitment to a post in a co-operative society is 18 years on the first day of January of the year in which the vacancies are advertised.
8 What is the upper age limit for application for employment through the Commission? The maximum age for recruitment to the posts in Groups A and B is 40 years and in Group C is 35 years on the first day of January of the year in which the vacancies are advertised, provided that for the candidates belonging Scheduled Castes, Scheduled Tribes and other Backward Classes categories the maximum age limit shall be relaxed by five years.
9 Can a co-operative society belonging to the Fifth Schedule of the West Bengal Co-operative Societies Act initiate departmental proceedings against any employee who has been appointed by the Commission? Yes, a co-operative society belonging to the Fifth Schedule of the West Bengal Co-operative Societies Act can initiate departmental proceedings against any employee who has been appointed by the Commission. But such an employee cannot be dismissed by the co-operative society without prior approval of the Commission. However, the Commission shall have to communicate its decision within two months from the date of receipt of any request in writing from the concerned co-operative society for such approval.
